Please read these conditions carefully before agreeing to book. You may only request a booking if you agree to these Terms. By submitting a Booking Request you are deemed to have accepted these Terms. This does not affect your statutory rights as a consumer.
We reserve the right to change these Terms at any time. Any such changes will take effect immediately when posted on the Website or otherwise brought to your attention. It is your responsibility to read the Terms each time you submit a Booking Request and any such request shall signify that you have accepted to be bound by the latest set of Terms. A copy of the latest set of Terms is available on the Website and upon request.
Making a Booking
Your agreement is between you and The Norfolk Brickyard Campsite. References to ‘the Company’, ‘we’, ‘us’, and ‘our’ in these terms and conditions apply to The Norfolk Brickyard Campsite. References to ‘you’ in these terms and conditions are to you, as the person making the booking and, where applicable, to every member of your party.
There will be a contract between you and us:
- If you book by telephone when we accept your initial payment
- If we issue you written confirmation
- If you book online and when your booking is confirmed
When you wish to place a booking for a holiday (“Booking Request”) with us, you will complete a booking form (either over the phone, by email, or at the Site). It is your responsibility to provide us with the correct information. If you have made the Booking Request via the telephone, we will read back your details to you. You will be responsible for the booking regardless of any input errors. The Booking Request is an offer by you to enter into a binding contract with us and we are free to accept or decline your offer at our absolute discretion. If we accept your Booking Request, we shall issue a written confirmation (containing a booking reference number) accepting your Booking Request. This written confirmation shall signify that we have accepted your Booking Request subject to these Terms. At this point a contract shall come into existence between you and us on these Terms.
The person making the booking accepts the contract on behalf of all members of your party and is responsible for making sure they accept the contract. We cannot accept bookings from anyone under the age of 18.
If half or more of the party is aged between 17 and 25, you must tell us when you book. We have the right to refuse your booking on arrival, to any persons or groups, at our discretion.
If you wish to book a single sex party you must tell us of this before you book.
We reserve the right to cancel any booking that we reasonably believe breaches our terms and conditions of booking.
Bookings are not transferable to another party.
You must check your hire invoice and booking acceptance as well as all other documents we send you carefully as soon as you receive them. If any information appearing on any document appears to be inaccurate in any way, you must let us know straight away. We regret we cannot accept any liability to make changes if we are not notified of any inaccuracy in any document within 7 days of our sending it out.
Telephone/ Internet/ Email & Postal Bookings will be held provisionally for up to 7 days until a deposit has been received. If we do not receive a deposit, your booking will be cancelled.
Duration Of Your Stay
All terms are on a day by day basis for the accommodation as equipped and described. The usual check-in time is 4pm (subject to unavoidable delays). The check-out time (usually 11am) will be shown on your hire invoice. We can be flexible on those times but we must be notified in advance. You are obliged to leave everything in a clean and tidy condition and you are responsible for any damage done or loss sustained during your stay. We reserve the right to charge guests for any damages made during your stay at The Norfolk Brickyard Campsite.
Prices include VAT (where applicable), at the rates applicable at the time of booking and are subject to change, if the rates or application of the tax changes. In the event of a change in the rate of VAT during the course of the year, your holiday will on behalf of the Owner be invoiced at the new amount of VAT unless you have already taken your holiday or paid the balance in full prior to the date of the change.
When you book you must pay the applicable deposit of 40% within 2 days of provisional booking, if we do not receive payment, your booking will be cancelled. If you prefer you can pay the whole amount.
Your balance is due on day of arrival. You can pay this by BACS with our bank details or by Paypal. Prices do not include any additional services, features and facilities unless expressly stated.
Cancelling Your Booking
Telephone us immediately if you have to cancel your booking. We have the right to refuse to refund your deposit, however, as standard practise; deposits are refunded to guests cancelling over 4 weeks from their arrival date. If you cancel within 4 weeks of your booking date, your deposit will not be refunded unless the space can be refilled.
Cancelations due to Covid related Government lockdown or restrictions
If the government send us or you into lockdown or other restricted conditions, that affect your booking, you will get your deposit back, no matter how many weeks it is until your booking. If you have to cancel because you or someone in your group has covid, then we may ask to see a doctors note.
Cancellations or Changes by the Owner
The Owners do not expect to have to make any changes to your booking. However, sometimes problems happen and bookings have to be changed or cancelled or mistakes in brochures or other details corrected. The owner has the right to do this. If we do, we will contact you (by phone if reasonably possible, in the case of a significant change or cancellation, we will let you know about minor changes) as soon as is reasonably practical. We will explain what has happened and let you know about the cancellation or change.
Number in Your Party
The total number in your party must not exceed the capacity of the accommodation as advertised by us. Babies will be counted as members of your party. You should check the policy of your chosen accommodation carefully before booking. This is for insurance purposes. Any guests found to have exceeded the capacity will be asked to leave immediately.
Check in time is after 3pm and before dark please. If you do arrive before this time, you are welcome to just relax in the surroundings until your accommodation is cleaned and made ready for your stay. We are happy to show you to your accommodation as soon as it is ready.
Linen and Cots
Bed linen is not provided. You will need to bring all your own bedding either sheets, duvets or blankets and pillows for each guest or sleeping bags. The Double bed is a king size and the bunk bed is two singles. A travel cot can be made available for your accommodation, please let us know in advance if this is required.
All the tents belonging to The Norfolk Brickyard Campsite are fully self catered. We provide cups, glasses, plates, bowls, pots, pans, kettle, cutlery, cooking utensils and a two ring gas burner. We do not provide cooking oil or other consumables.
We ask all guests, group bookings in particular, to be respectful to other guests during their stay. Please keep noise and bad language to a minimum wherever possible. We have the right to refuse to hand over accommodation if the unreasonable behaviour of anyone in your party is likely to cause offence to other guests or to members of staff. We reserve the right to terminate a holiday, if the unreasonable behaviour of anyone in your party is likely to impair the enjoyment, comfort or health of other guests or members of staff. In these circumstances, no refund will be given.
Damage to Accommodation
You are liable to The Norfolk Brickyard Campsite for any damage caused in the accommodation during the period of hire. The Norfolk Brickyard Campsite has the right to enter any accommodation (without prior notice if this is not practical or possible) if special circumstances or emergencies arise (for example if repairs need to be carried out).
Our site is family run. The family is capable of dealing with all matters of policy at our sole discretion when the need arises. In placing a Booking Request you agree that you and your party will at all times comply with requests of the family. As the person booking the holiday, you are responsible for the behaviour of all members of the party whilst on the Site.
Children remain the responsibility of their parents or guardians at all times on the Site and during activities. Please ensure your children are supervised at all times.
We do not allow pets on the site. This is for the safety of the pets as we have gamekeepers who are on the hunt for foxes and other predators. Any guests found to not be respecting this rule regarding to pets, may be asked to leave immediately.
Your Vehicles and Belongings
Your vehicles, belongings, their accessories and contents are left entirely at your risk. The Norfolk Brickyard Campsite are not responsible for any loss or damage to your belongings, or loss or damage from or to any vehicle from any cause whatsoever.
We want you to have an enjoyable holiday. Should you have cause for complaint, please contact our Site Manager immediately who will try to resolve your issue and advise you of our complaints procedure.
Please read this section as it is important that you understand what you are agreeing to Nothing in this section limits or attempts to limit our liability for: (a) death or personal injury caused by our negligence; or (b) fraud or fraudulent misrepresentation; or (c) any breach of the obligations implied by section 2 of the Supply of Goods and Services Act 1982; or (d) losses for which it is prohibited by section 7 of the Consumer Protection Act 1987 to limit liability; or (e) any other matter for which it would be illegal or unlawful for us to exclude or attempt to exclude our liability. Subject to the matters detailed above, if we fail to comply with these Terms, we shall not be responsible for any losses that you suffer as a result, except for those losses which we could reasonably foresee would result from our failure to comply with these Terms. In addition to above, we shall not be responsible for any: (a) loss of income or revenue; (b) loss of business; (c) loss of anticipated savings; or (d) loss of data. Our maximum liability shall be no more than to refund the amount paid by you for the holiday.
As our site are located in a forest environment, we do not accept responsibility for any damage, injury or inconvenience caused by plants or wildlife.
The Norfolk Brickyard Campsite does not accept responsibility for anything which adversely affects your holiday which is outside of our control. These circumstances are known as ‘Force Majeure’ events and are circumstances that the brickyard could not, even with due care, have foreseen or avoided. Such circumstances include (but are not limited to) war, civil unrest, industrial action, terrorist activity, natural disaster, fire, adverse weather conditions, foot and mouth disease and all other similar events outside of our control.
The Norfolk Brickyard Campsite will endeavour to manage any problems caused as a result of a Force Majeure event but shall be under no obligation to do so and shall not be liable to you for any losses caused by a Force Majeure event. Reference to any products, services or other information belonging to third parties does not imply or constitute an endorsement, sponsorship or recommendation by The Brickyard. Links to other services not operated by The Brickyard are provided solely for your convenience. The Brickyard accepts no liability for any products, services, or other information provided by third parties.
Other important Information
Any photographs, descriptions or advertising we issue, and any descriptions or illustrations contained in our catalogues on the Website, are issued or published solely to provide you with an approximate idea of our site and the services. They do not form part of the contract between you and us. If any court or competent authority decides that any of the provisions of these Terms are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law. If we fail, at any time while these Terms are in force, to insist that you perform any of your obligations under these Terms, or if we do not exercise any of our rights or remedies under these Terms, that will not mean that we have waived such rights or remedies and will not mean that you do not have to comply with those obligations. Any waiver of a default by us does not mean that we will automatically waive any subsequent default by you. No waiver by us of any of these Terms shall be effective unless we expressly say that it is a waiver and we tell you so in writing.
